BACKGROUND

The City had one existing 6-inch waterline located in McFadden Avenue and one existing 8-inch waterline in Magnolia Avenue that were in conflict with the proposed I-405 improvements. As such, these waterlines were required to be relocated.

Approving the subject Utility Agreements between OCTA and the City gives OCTA the authority to relocate the City-owned waterlines, at OCTA’s expense, and provides for the reimbursement of $21,756 to the City for staff time related to plan review/approval and construction inspection.

It is important to note that OCTA originally expected the City to bear the cost of relocating all utility conflicts.  However, it has been determined through the diligent research of old archived files by City staff that the cost for relocation of City-owned utilities is to be fully paid by OCTA.

FISCAL IMPACT

The reimbursement amount of $21,756 for the work related to the subject Utility Agreements No. UK149203 and UK149204 will be allocated into the following accounts:

General Fund 100 - 50500-40091 (I-405 Reimbursement) - $8,470

Water Fund 600 - 55500-40091 (I-405 Reimbursement) - $13,286

LEGAL REVIEW

CONCLUSION

The approval of the subject agreements will allow the City to receive $21,756 from OCTA for staff time to review/approve the plans and provide construction inspection.
