BACKGROUND
On November 8, 2023, the Mayor and City Council adopted Resolution No. 5225, establishing the Measure Y Citizens Oversight Committee and adopting the Committee’s roles and responsibilities.
To remain consistent with other Boards and Commission terms, modified language is recommended to clarify the terms of those appointed to the committee. If adopted, the attached resolution confirms the establishment of the Citizens Oversight Committee, but seeks to modify the term of office for Committee members so that it is more closely tied to the term of office of the appointing council member.
The modified language would state that “A member’s term in office shall continue in effect until the first of following events to occur: the date the appointing council member take action to remove their appointed member from office, the date the appointing council member’s own term in office ends, or the date Measure Y terminates by its own terms.”
This recommended language is consistent with the City Council’s past concerns to ensure incoming council members have the ability to select a committee member, rather than have members serve past a council member’s leaving office date.

LEGAL REVIEW
The City Attorney’s Office has reviewed as to form.
CONCLUSION
The Measure Y Citizens Oversight Committee is required as part of the implementation of Measure Y, the No-Tax Increase Local Services ballot measure to extend collection of the one-cent (1%) transaction and use (sales) tax which was previously approved by the residents with Measure SS in November 2016. This item is to ensure that the Committee is consistent with other City Boards and Commission’s when it comes to terms for members.
