RECOMMENDED ACTION
Recommendation
Adopt a Resolution entitled, “A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF WESTMINSTER, CALIFORNIA, ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2024-2025 FUNDED BY SENATE BILL 1 (SB1), THE “ROAD REPAIR AND ACCOUNTABILITY ACT.”
end
BACKGROUND
In April 2017, the Governor signed Senate Bill 1 (SB1), which is known as the “Road Repair and Accountability Act of 2017”, to address the basic road maintenance, rehabilitation, and critical safety needs on both, the State Highway and Local Streets and Roads. SB 1 increases the gallon fuel excise taxes, diesel fuel sales taxes, and vehicle registration fees to generate new transportation revenues for road repairs.
Annually, the State Controller will deposit various portions of this new funding into the Road Maintenance and Rehabilitation Account (RMRA). Administered by the California Transportation Commission (CTC), these funds will be apportioned, on a per capita basis, to eligible cities and counties pursuant to the Streets and Highways Code (SHC) provisions.
The estimated funding from the State Department of Finance indicates that the City of Westminster will receive approximately $2,328,853 for Fiscal Year 2024-2025. For the City to receive this funding, a yearly proposed list of streets and an adopted resolution will need to be submitted to the CTC for review and approval.
Eligible projects from this funding source are:
• Road maintenance and rehabilitation; and
• Safety projects; and
• Railroad grade separations; and
• Complete street components (including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and stormwater capture projects in conjunction with any other allowable project); and
• Traffic control devices.
Based on the abovementioned RMRA requirements, staff has reviewed the City’s Pavement Management Program and identified the following road rehabilitation projects to be submitted for funding:
• Goldenwest Street from Garden Grove Boulevard to Westminster Boulevard
The abovementioned streets are listed on the CIP list in the proposed Fiscal Year 2024-2025 budget as “Citywide Arterial Street Improvements (SB1).”
As part of SB1’s various accountability and transparency measures, the city is required to submit the proposed list of streets and adopt the subject resolution by July 1, 2024. Additionally, an annual progress report detailing the project status and expenditures will need to be submitted to the CTC by December 1, 2024.
FISCAL IMPACT
The estimated $2,328,853 in RMRA funding is proposed to be budgeted in Fiscal Year 2024-2025 in the following Capital Improvement Account:
• 55036-362501, “Citywide Arterial Street Improvements (SB1)”, in the amount of $2,328,853
The above expenses will be offset by State Revenue Account 55005-34250 I/GVT-State RMRA.
LEGAL REVIEW
The City Attorney’s Office has reviewed as to form.
CONCLUSION
This is a vital funding source for the city which will enable staff to continue road maintenance and safety improvements projects. Fiscal Year 2024/2025 will be the eighth year of receiving RMRA funding. Therefore, staff are well equipped to manage this fund and execute these projects.
