BACKGROUND

Last year, the City requested that the State increase its maintenance efforts in various areas within the City of Westminster. In response, the State requested that the City enter into the subject agreement for litter, debris, and fence maintenance along a portion of Beach Boulevard. With this agreement, the City will proactively perform such maintenance operations along a portion of Beach Boulevard and the embankment of State Route 22 as shown in the Exhibit B of the agreement (Attachment 1). The City of Westminster will coordinate with the City of Garden Grove, who has already entered into a similar agreement for their portion of the area, to ensure that maintenance efforts are effective.

The subject agreement is the standard State language and cannot be altered. As such, there are other maintenance responsibilities stated, such as weed abatement and graffiti removal, that do not pertain to this agreement. The City will only be responsible for removing litter, debris, and homeless encampments in the area outlined in Exhibit B. Additionally, the City will be responsible for maintaining the fence along the Hoover Street undercrossing and a short fence north of the Costco Business Center as necessary. The total maintenance costs will be reimbursed in the not-to-exceed annual amount of $25,000, as shown in Exhibit A of the agreement (Attachment 1).

Staff will closely track the expenditures required for effective cleanup and work with Caltrans to increase the budget amount, expand the area, and/or identify new areas where shared maintenance may be expanded.

FISCAL IMPACT

The cost for the litter, debris, and fence maintenance for a portion of Beach Boulevard and the embankment of State Route 22 will be reimbursed by the State in the not-to-exceed annual amount of $25,000.

The following allocations are needed:

•                     An increase to the Revenue Budget, Account Number 51500-39069 (Street Maintenance - Reimbursement - Other) in the amount of $25,000; and

•                     An increase to the Expenditure Budget, Account Number 51500-43090 (Street Maintenance - Contractual) in the amount of $25,000.

LEGAL REVIEW

The City Attorney’s Office has reviewed as to form.

CONCLUSION

Approve the subject agreement to aesthetically improve a portion of Beach Boulevard and the State Route 22 corridor. The subject area will be inspected regularly to ensure effectiveness and may be expanded if necessary. If the area is expanded, the City will work with the State to secure a higher reimbursement.
