BACKGROUND

On March 11, 2021, President Joe Biden signed the American Rescue Plan Act of 2021 (ARPA) into law to address the economic and health impacts due to the COVID-19 pandemic. The legislation allocated $130.2 billion to be evenly divided among the counties based on population ($65.1 billion) and cities using the modified Community Development Block Grant formula ($65.1 billion). As a result, the City of Westminster received an allocation of $23.7 million. A portion of this allocation will be used to fund the Cherry Street Community Garden project.

The subject ARPA-funded project was selected through various study sessions and ultimately approved by the Mayor and City Council in 2022 and 2024.

The Public Works and Community Services and Recreation Departments held an in-person community outreach meeting on May 23, 2024, and virtually via Zoom on May 28, 2024 for the subject project. The valuable input received from the community was reviewed by staff and incorporated into the project plans to meet the needs and expectations of the users.

The scope of work consists of:

•                     Clearing and grubbing;

•                     Installation of concrete sidewalk, decomposed granite, driveway, wrought iron fence and gate; and

•                     Installation of irrigation system, water hose bibb, benches, tables, trash receptacles, raised planter boxes, plants, and trees.

Per Westminster Municipal Code 3.44.120, the City Council shall adopt plans and specifications for all public projects requiring the formal bid procedure, pursuant to Public Contract Code Section 22039.

City staff has completed the plans and specifications, and the Public Works Director has approved the plans and specifications for the bidding. The engineer’s estimate for construction on this project is $333,870.

Advertising for competitive bidding and the bidding process will be done in accordance with the Public Contract Act and Uniform Cost Account Act. In accordance with the Procurement Policy, staff will return to the Mayor and City Council to recommend award of the contract.

The bid opening is planned for October 3, 2024, with the anticipated award date of October 23, 2024. Construction will subsequently commence in January 2025.

FISCAL IMPACT

Funding for this project is allocated in the ARPA CIP account:

•                     Account No. 21500 - 212313
