RECOMMENDED ACTION
Recommendation
A. Approve a budget adjustment from the Park Dedication Fund balance (Fund 200) to a newly created CIP Project, Account Number, 76502-762504 in the amount of $73,044.80; and
B. Approve the award of contract to the lowest and responsible bidder in the amount of $352,143.45 to Western State Builders, Inc. and that all other bids be rejected; and
C. Authorize a 10% contingency in the amount of $35,214.35 for potential change orders; and
D. Authorize the City Manager to execute the contract on behalf of the City, in a form approved by the City Attorney.

A bid comparison of the submitted bids is attached to this report.
The purchase of the playground equipment was approved by the Mayor and City Council on February 12, 2025. The plans and specifications were approved by the Mayor and City Council on April 9, 2025.
The subject project’s work consists of:
• Removing and disposing the existing concrete flatwork, playground equipment, footing, sand; and rubber playground surface;
• Performing site grading; and
• Installing new Portland cement concrete sidewalk, curb, benches, playground equipment, rubber playground surface, and all appurtenant work in connection therewith.
FISCAL IMPACT
Funding for the contract with Western State Builders, Inc., including the 10% contingency, in the amount of $387,357.80 is available in the following accounts with the proposed budget adjustment:
• Account No. 16510-162401, “Playground Replacement Elden Gillespie“ in the amount of $314,313.
• A budget adjustment from the Park Dedication Fund balance (Fund 200) to a newly created CIP Project, Account Number 76502-762504 in the amount of $73,044.80.
LEGAL REVIEW
The City Attorney’s Office has reviewed as to form.
CONCLUSION
Approve the award of contract to the lowest and responsible bidder, Western State Builders, Inc. for the Playground Renovation for Elden F. Gillespie Park - Project No. P-2639. Western State Builders, Inc. has also performed satisfactorily for the City of Westminster on multiple playground renovation projects in the past.
