RECOMMENDED ACTION
Recommendation
A. Approve the Professional Services Agreement with RSG, Inc. for on-call housing, community development, and related consulting services; and
B. Authorize the City Manager or designee to execute the agreement, in a form approved by the City Attorney, with a not to exceed contract amount of $100,000.
BACKGROUND
The City of Westminster administers a wide range of complex housing and community development programs and responsibilities that support the City’s efforts to preserve and expand affordable housing opportunities, address community needs, and ensure compliance with State and Federal requirements. These responsibilities include the administration of affordable housing activities, implementation of housing policies, and oversight of multiple funding sources.
In particular, the City manages federally funded programs such as the HOME Investment Partnerships Program (HOME) and the Community Development Block Grant (CDBG) program, as well as compliance and reporting obligations associated with other State and Federal housing initiatives. These programs require specialized expertise in areas such as eligibility determinations, financial underwriting, subsidy layering analysis, program administration, and adherence to detailed State and Federal regulatory requirements.
In addition, the City has ongoing long-term obligations related to the monitoring and enforcement of affordability restrictions for assisted housing developments, including annual compliance reviews, income and rent limit verification, and regulatory reporting. The City must also remain responsive to evolving State housing laws, Housing Element implementation requirements, and other statutory mandates that affect local housing and community development activities.
Given the technical and highly regulated nature of these programs, the City periodically relies on qualified professional consultants to provide on-call support services. On-call consulting services allow the City to access specialized expertise on an as-needed basis, supplement staff capacity, respond efficiently to time-sensitive program demands, and ensure that housing and community development initiatives continue to advance in a timely and compliant manner.
Procurement / RFQ Process and Selection
To ensure the City retains highly qualified professional support for housing, community development, and related consulting services, the City issued a Request for Qualifications (RFQ) for On-Call Housing, Community Development, and Related Services. The RFQ process was intended to identify firms with demonstrated expertise in affordable housing finance, Federal and State program compliance, long-term monitoring, and advisory services necessary to support the City’s ongoing housing initiatives.
The RFQ was formally released on October 9, 2025 through the City’s GovDelivery notification system and posted on the City’s website to solicit Statements of Qualifications from qualified firms. Following release of the solicitation, the City provided an opportunity for interested firms to submit written questions, with questions due no later than October 27, 2025. Responses to questions, clarifications, and any addenda were made available through the City’s website in accordance with the RFQ requirements.
Statements of Qualifications were required to be submitted to the City by 4:00 p.m. on Tuesday, November 18, 2025. The City evaluated responses based on qualifications, relevant experience with comparable jurisdictions, knowledge of applicable State and Federal housing regulations, capacity to provide timely on-call support, and the ability to serve as an extension of City staff on complex matters.
Following review of the submitted qualifications, RSG, Inc. was identified as a highly qualified firm with extensive experience assisting California cities and counties with housing program administration, underwriting, compliance monitoring, and policy implementation. RSG, Inc. has a strong track record providing on-call consulting services to public agencies, including County of Orange, County of San Diego, and cities such as Merced, Chula Vista, and Huntington Beach.
Under the proposed agreement, RSG, Inc. would provide as-needed professional support in areas such as:
• Affordable housing underwriting and subsidy layering reviews.
• Preparation and negotiation of regulatory agreements.
• Housing Successor Agency and SB 341 reporting.
• Compliance monitoring and file audits as required by State and Federal regulations.
• Federal and State grant technical assistance (HOME, CDBG, HOME-ARP, PLHA, etc.).
• General housing policy advisory services.
These services will allow the City to respond efficiently to State and Federal regulatory deadlines without requiring additional permanent staffing.
FISCAL IMPACT
There is no fiscal impact to the City’s General Fund. The agreement will be for a term through December 31, 2027, with services provided on an as-needed basis, and a not-to-exceed contract amount of $100,000. Contractual funding is available within the HOME Program administration budget account 242-17403-43090.
LEGAL REVIEW
The City Attorney’s Office has reviewed as to form.
CONCLUSION
Approval of an on-call professional services agreement with RSG, Inc. will provide the City with experienced and flexible technical support to advance affordable housing goals, maintain compliance with State and Federal requirements, and assist City staff with complex housing and community development responsibilities.
