RECOMMENDED ACTION
Recommendation
Accept the subject project and authorize the City Clerk to file a Notice of Completion with the County Clerk-Recorder’s Office.

BACKGROUND
On April 9, 2025, the Mayor and City Council approved the plans and specifications for the subject project and authorized staff to advertise the project. On June 11, 2025, the contract was awarded to Western State Builders, Inc. in the amount of $352,143.45, with a 10% contingency allowance of $35,214.35 for potential change orders, bringing the total approved project amount to $387,357.80. This project is funded by CDBG and Park Dedication funds.
The original scope of work consisted of:
• Removing and disposing of the existing concrete flatwork, playground equipment, footing, sand, and rubber playground surface;
• Performing site grading for the new playground; and
• Installing new playground equipment, footing, rubber playground surface, concrete sidewalk, curb, landscaping, and benches.
The contract has since been completed by Western State Builders, Inc. A total of $34,194.08 in change orders was approved, bringing the final project cost to $386,337.53. The additional funding used is within the previously approved contingency amount. The increase is due to extra quantities of concrete sidewalk and landscaping work. The work performed by Western State Builders Inc. has been inspected and approved by the landscape architect, a third-party licensed playground inspector, and city staff.
The ribbon-cutting date for the new playground is scheduled for April 1, 2026, at 2:00 PM.
FISCAL IMPACT
The total construction cost, in the amount of $386,337.53, for the contract with Western State Builders, Inc., is budgeted in the following accounts:
• Account No. 16510-162401, “Playground Replacement Elden Gillespie” in the amount of $314,313.
• Account No. 76502-762504, “Playground Replacement Elden Gillespie” in the amount of $72,024.53.
LEGAL REVIEW
The City Attorney’s Office has reviewed as to form.
CONCLUSION
The contract has been satisfactorily completed by Western State Builders, Inc. It is recommended that the Mayor and the City Council accept the subject project and authorize the City Clerk to file a Notice of Completion with the County Clerk-Recorder’s Office.
