BACKGROUND

The proposed Parcel Map represents the first application submitted to the City related to Senate Bill 9 (SB 9). Effective January 1, 2022, SB 9 is the California law that allows homeowners to subdivide a single-family lot into two parcels and develop up to two separate units on each resulting parcel. The intent is to increase the housing supply.

The subject property is approximately 12,659 square feet in area. It is located west of Newland Street, about 215 feet north of 23rd Street (13581 Newland Street). The subdivision will allow each parcel to be sold separately. Staff confirmed the proposed Final Parcel Map is in substantial conformance with the approved Tentative Parcel Map.

Pursuant to the provisions of the Subdivision Map Act and the City Municipal Code Chapter 16, Final Parcel Maps require City Council action for approval, denial, or modifications.  Per Subdivision Map Act Section 66474.1, a legislative body shall not deny approval of a final or parcel map if it has previously approved a tentative map for the proposed subdivision if it finds that the final or parcel map is in substantial compliance with the previously approved tentative map. Tentative Parcel Map 2023-163 was approved by the Planning Department on April 16, 2025.

FISCAL IMPACT

None.
