RECOMMENDED ACTION
Recommendation
Approve a First Amendment to Agreement No. 2026-036 with EMTS, Inc., dba Elite Maintenance and Tree Service, for additional landscape maintenance services for parks and city facilities and new pest control services, increasing the annual not-to-exceed amount by $61,332, for an approximate aggregate amount of $1,893,152.96, with Consumer Price Index (CPI) increases.

BACKGROUND
The City currently contracts with EMTS, Inc., dba Elite Maintenance and Tree Service (Elite) for landscape maintenance at City parks, the Civic Center, Rose Center, Chamber of Commerce, Police Department Training Facility, Corporation Yard, greenbelt areas, and water well sites. The current agreement with Elite was approved by the Mayor and City Council on June 12, 2024, for an initial one-year term with up to four one-year extensions. The initial annual not-to-exceed amount was $297,207.72 with a 10% contingency in the amount of $29,720.77 for unforeseen maintenance items and allows for CPI increases.
The current agreement provides comprehensive landscape maintenance services, including mowing, shrub trimming, weed abatement, irrigation monitoring, debris and trash removal, mulch installation, aeration, and annual fertilizer and pesticide applications.
Since the execution of the agreement, the City has completed several capital improvement projects, including the Community Garden and Cherry Street Eats projects. These new amenities include landscaped areas that require ongoing maintenance to preserve their appearance, functionality, and long-term health. Additionally, staff has identified the need for routine landscape maintenance for the parkway area located on the southwest corner of the intersection of Magnolia Street and Edinger Avenue.
The City has also experienced increased pest activity at several municipal facilities and landscaped properties. To address these concerns, staff utilized pest control services provided by Elite on a trial basis and achieved favorable results. Based on the effectiveness of these services, staff recommends incorporating routine pest control services into the existing agreement.
The amended agreement will expand the scope of services to include the following:
1. Community Garden and Cherry Street Eats (located at Westminster Boulevard and Cherry Street) - Bi-weekly landscape maintenance.
2. Magnolia Street and Edinger Avenue Parkway - Bi-weekly landscape maintenance.
3. Citywide Pest Control Services at City parks, Civic Center, and greenbelt areas - Weekly service.
The proposed amendment will ensure that recently completed City improvements receive the same level of maintenance as other City facilities and will provide a proactive approach to managing pest-related issues throughout City-owned properties.

FISCAL IMPACT
Funds for Amendment No. 1 in the not-to-exceed yearly amount of $61,332 are budgeted for Fiscal Year 2026-2027 under Account No. 53000-43090 “Park Maintenance - Contractual” (Fund 100 - General Fund), bringing the current estimated not-to-exceed aggregate amount to $1,893,152.96.

CONCLUSION
The City has recently completed several landscape improvement projects through its Capital Improvement Program, resulting in additional landscaped areas that require ongoing maintenance. Furthermore, the addition of routine pest control services will help protect City facilities and landscaped properties from pest-related damage and nuisance conditions. Approval of Amendment No. 1 will ensure that these assets are properly maintained, preserve the City's investment in public improvements, and enhance the overall appearance, safety, and enjoyment of City facilities for residents and visitors.
