RECOMMENDED ACTION

 

Recommendation

A.                     Approve the Professional Services Agreement with Bureau Veritas Technical Assessments LLC in the amount of $395,304.74 for the development of an ADA Self-Evaluation and Transition Plan; and

 

B.                     Authorize a 10% contingency in the amount of $39,530.47 to address unforeseen change orders that may arise during the project; and

 

C.                     Authorize the City Manager or designee to execute the agreement, in a form approved by the City Attorney.

BACKGROUND

 

The Americans with Disabilities Act (ADA) of 1990 is a Federal law prohibits discrimination against individuals with disabilities in public services, programs, and activities. Under Title II, local agencies are required to have their public facilities, services, programs, and public right-of-way accessible to individuals with disabilities.

 

Federal regulations require public agencies with 50 or more employees to develop an ADA Self-Evaluation and Transition Plan (Plan). The Self-Evaluation identifies any accessibility barriers, while the Plan outlines a priority, budget-conscious plan for removing these obstacles over time.

 

The Plan will assess public facilities, parks, sidewalks, curb ramps, crossings, parking, and other infrastructure. It will also develop a comprehensive database, identify deficiencies, establish improvement priorities, prepare estimated costs, and develop strategies to support future planning and grant opportunities.

 

On January 12, 2026, the City issued a Request for Proposals (RFP) to solicit proposals from qualified firms with demonstrated experience. The RFP was posted to the City’s website and sent to interested firms that have prepared ADA transitions plans for similar jurisdictions. Staff received three proposals. A review committee consisting of the City Engineer, Maintenance and Utilities Manager, and Building Official evaluated the proposal based on the following categories:

 

                     Project Understanding

                     Firm Experience

                     Key Staff Qualifications

                     Methodology

                     Field Inventory

                     GIS/Database

                     Public Outreach

                     Scheduling and Staffing

                     Training & Maintenance

 

Two firms were selected for interviews. Following the review of the submitted proposals and the interviews, Bureau Veritas Technical Assessments LLC was determined to be the best qualified proposer based on qualifications, technical approach, project understanding, experience, and overall value to the City. The Plan includes, but not limited to, the assessment of 16 city-owned buildings, 25 parks, 335 miles of sidewalk (including curb ramps, and signalized intersections (72 signals).

 

Preparing a Plan will help the City:

 

                     Enhance the accessibility and usability of public facilities and infrastructure for all residents and visitors.

                     Systematically identify and prioritize accessibility barriers.

                     Support long-term planning for capital improvements and ongoing maintenance.

                     Improve eligibility and competitiveness for State and Federal grant funding.

                     Reduce legal and regulatory risks associated with ADA noncompliance.

 

The proposed Plan is designed to give the City a web-based ADA database that can support the development of budget and capital planning efforts and be regularly updated and maintained over time.

 

During the ADA evaluation process, additional public right-of-way or other facilities may be identified that were not included in the original scope of work but require evaluation and incorporation into the Plan. The contingency amount is intended to cover for these unforeseen additions.

 

FISCAL IMPACT

 

Funding Plan in the amount of $434,835.21 is budgeted in the following CIP Accounts:

 

                     20002-001800, “City-wide Street Improvements”, in the amount of $34,835.21; and

 

                     20002-002602, “City-wide ADA Assessment and Transition Plan”, in the amount of $400,000.

 

LEGAL REVIEW

 

The City Attorney’s Office has reviewed as to form.

 

CONCLUSION

 

Approving the subject agreement will allow Bureau Veritas Technical Assessments LLC to prepare a comprehensive ADA Self-Evaluation and Transition Plan. The Plan will assist the City in improving accessibility, supporting long-term infrastructure planning, and maintaining compliance with Federal ADA requirements.
