RECOMMENDED ACTION

 

Recommendation

A.                     Approve the subject Addendum No. 1 to the Delegated Maintenance Agreement between the City of Westminster and the State of California, acting by and through the Department of Transportation for litter, debris, and fence maintenance along a portion of Beach Boulevard; and

 

B.                     Approve an increase to the Fiscal Year 2025-26 Revenue Budget, Account Number 51500-39069 (Street Maintenance - Reimbursement - Other) in the amount of $200,000; and

 

C.                     Approve an increase to the Fiscal Year 2025-26 Expenditure Budget, Account Number 51500-43090 (Street Maintenance - Contractual) in the amount of $200,000; and

 

D.                     Authorize the City Manager to execute the addendum on the City’s behalf, in a form approved by the City Attorney.

BACKGROUND

 

On August 14, 2024, the Mayor and City Council approved the original Delegated Maintenance Agreement (“DMA”) with the State, establishing responsibilities for litter, debris, and fence maintenance along a section of Beach Boulevard and the embankment of State Route 22 (Exhibit B). The agreement included an annual not-to-exceed amount of $25,000.

 

The State is proposing an addendum to the original DMA to provide the City with a one-time allocation of $200,000. These additional funds would be used to expand the litter and debris removal efforts within the originally designated maintenance area, as well as a nearby section of Beach Boulevard and the Interstate 405 Freeway, within the City’s jurisdiction (Attachment 3).

 

This one-time allocation must be expended by June 30, 2027.

 

FISCAL IMPACT

 

The following allocations for Addendum No. 1 to the DMA between the City and the State are needed:

 

                     An increase to the Revenue Budget, Account Number 51500-39069 (Street Maintenance - Reimbursement - Other) in the amount of $200,000; and

 

                     An increase to the Expenditure Budget, Account Number 51500-43090 (Street Maintenance - Contractual) in the amount of $200,000.

 

LEGAL REVIEW

 

The City Attorney’s Office has reviewed as to form.

 

CONCLUSION

 

The proposed addendum would assist in aesthetically improving various portions of Beach Boulevard in the vicinity of the State Route 22 and Interstate 405 freeway corridors. The designated areas will be inspected regularly to ensure ongoing maintenance and cleanliness.
