Authorize an increase of $106,307.79 in additional funds to Union Pacific Railroad Company for railroad crossing improvements related to the completion of the Mendez Freedom Trail Project.

BACKGROUND
On June 12, 2024, the Mayor and City Council approved seven (7) Public Highway At-Grade Crossing Agreements with Union Pacific Railroad Company (UPRR). These agreements included safety improvements and traffic signal amenities at railroad crossing locations along Hoover Street at Garden Grove Boulevard, Trask Avenue, 21st Street, Westminster Boulevard, Main Street, Hazard Avenue, and Bolsa Avenue, as required by UPRR.
The improvements included:
• Installation of pre-signals, markings, and signage;
• ADA improvements;
• Side railroad flashing lights; and
• Railroad crossing improvements at Garden Grove Boulevard, Hazard Avenue, 21st Street, and Trask Avenue.
The agreements allowed UPRR to make necessary crossing improvements along Hoover Street and required the City of Westminster to reimburse UPRR for the construction costs. The improvements enhance safety for vehicles, bicyclists, and pedestrians at the railroad crossings that connect to the Mendez Freedom Trail. The total cost of the improvements was estimated at $1,895,475, with UPRR sharing the cost of improvements at 21st Street, Garden Grove Boulevard, and Trask Avenue in the amount of $351,512. The estimated remaining cost for the City was $1,543,963. Due to an increase in material costs over the duration of the project, the final construction cost is $1,650,270.79, which is 6.9% higher than the estimated amounts included in the agreements.
The Mendez Freedom Trail is complete, with the Mayor and City Council accepting the project on May 13, 2026 and the dedication taking place on April 14, 2026.
FISCAL IMPACT
The balance due to UPRR, in the amount of $106,307.79, is available in CIP Account No. 20002-002101, “Citywide Street Improvements.”
LEGAL REVIEW
The City Attorney’s Office has reviewed as to form.
CONCLUSION
Authorizing an increase of $106,307.79 in additional funds will close out the project with UPRR for the railroad crossing improvements that connect to the Mendez Freedom Trail.
