Accept a new storm drain easement and authorize the City Clerk to record the deed with the County Recorder’s Office.

BACKGROUND
On August 28, 2024, the Mayor and City Council approved the development of 25 residential condominium units (Brandywine Homes - Solara) on the east side of Goldenwest Street, approximately 240 feet north of Fenway Drive. Prior to development, the project site was part of the adjacent church property. The project has since been completed.
Since the completion of the project, the area has experienced recurring flooding. To mitigate flooding in the area, the developer conducted a hydrology study and proposed to install approximately 177 feet of 18” reinforced concrete storm drain pipe. Due to the location of underground utilities within the public right-of-way, it is necessary to construct the proposed storm drain on the adjacent church property. The church is granting a new 5-foot easement along the easterly side of the sidewalk within their property, which is required for the developer to construct a new storm drain system, including a catch basin and a storm drain pipe. This new 5-foot easement is 155 feet long, located on the east side of Goldenwest Street, about 80 feet north of Fenway Drive.

The City Attorney’s Office has reviewed as to form.
CONCLUSION
This subject easement will allow the City to assume ownership and maintenance responsibilities for the proposed storm drain upon its completion by the developer.
